Spousal Maintenance

A major concern for many people following the breakdown of their relationship is how they will continue to financially support themself.

Spousal maintenance is a payment by one partner to the other to assist the partner receiving the payment to support themself. The payment is usually periodic such as weekly or monthly.

In order to be entitled to spousal maintenance, a person must not be able to financially support themself on the income that is available to them. The person from whom spousal maintenance is sought must have the financial capacity to provide spousal maintenance.

Spousal maintenance can be a short or long term payment, depending on the circumstances.

It must be distinguished from child support which is financial support for children. Spousal maintenance is for the financial support of a spouse.
